Violência doméstica e exercício das responsabilidades parentais: uma análise das decisões judiciais

| dc.description.abstract | Contrariamente às recomendações da Convenção de Istambul, a literatura sugere que os Tribunais de Família e Menores (TFM) continuam a decidir por regimes de partilha das Responsabilidades Parentais (RP), em casos onde ocorre ou é alegada Violência Doméstica (VD) entre progenitores, colocando a segurança das vítimas, especialmente mulheres e crianças, em risco. Com o objetivo de analisar de que modo as decisões judiciais proferidas em processos de Regulação das Responsabilidades Parentais (RRP), onde foi alegada VD, cumprem com as diretivas da Convenção de Istambul e de conhecer os fatores que estão na base dessas decisões, foram realizadas entrevistas semiestruturadas a seis magistradas/os de TFM. Da análise qualitativa dos dados emergiram três temas principais que se reportam às características dos processos (quanto à prevalência das alegações e à articulação entre as áreas crime e cível), aos fatores na base das decisões judiciais (avaliação de risco, acordo entre as partes, alegações falsas, opinião das crianças e Convenção de Istambul) e aos impactos da partilha das RP entre a vítima e a pessoa ofensora (escalada da violência e instrumentalização das crianças). Os resultados suportam a literatura sobre o tema e permitem refletir acerca da importância de formar estas/es profissionais acerca das dinâmicas da VD, para que as suas decisões não favoreçam a perpetuação da violência. | pt_PT |
| dc.description.abstract | Contrary to the recommendations of the Istanbul Convention, the literature suggests that Family Courts continue to rule on shared custody regimes in cases where domestic violence between parents occurs or is alleged, putting victims' safety, especially women and children, at risk. In order to analyze how the judicial decisions were rendered in custody proceedings where alleged domestic violence occurred, to comply with the directives of the Istanbul Convention, and to understand the factors that underlie these decisions, semi-structured interviews have been carried out with six family courts' magistrates. From the qualitative analysis of the data, three main themes emerged that relate to the characteristics of the processes (in terms of the prevalence of allegations and the articulation between the criminal and civil areas), the factors underlying the decisions (risk assessment, agreement between parents, false allegations, children's opinion and the Istanbul Convention) and the impacts of sharing custody between the victim and the offending person (escalation of violence and instrumentalization of children). The results support the literature on the subject, allowing reflection on the importance of training these professionals on the dynamics of domestic violence so that their decisions do not favor its' perpetuation. | pt_PT |
