Abstract(s)
Contrary to the recommendations of the Istanbul Convention, the literature suggests that Family Courts continue to rule on shared custody regimes in cases where domestic violence between parents occurs or is alleged, putting victims' safety, especially women and children, at risk. In order to analyze how the judicial decisions were rendered in custody proceedings where alleged domestic violence occurred, to comply with the directives of the Istanbul Convention, and to understand the factors that underlie these decisions, semi-structured interviews have been carried out with six family courts' magistrates. From the qualitative analysis of the data, three main themes emerged that relate to the characteristics of the processes (in terms of the prevalence of allegations and the articulation between the criminal and civil areas), the factors underlying the decisions (risk assessment, agreement between parents, false allegations, children's opinion and the Istanbul Convention) and the impacts of sharing custody between the victim and the offending person (escalation of violence and instrumentalization of children). The results support the literature on the subject, allowing reflection on the importance of training these professionals on the dynamics of domestic violence so that their decisions do not favor its' perpetuation.
