Existem questões que o formalismo processual adversarial não se mostra apropriado para resolver. Num contexto em que a concepção de família se renova, a compreensão do acesso à justiça é levada a reboque, pressupondo mudanças na ritualística civil e seus métodos de abordagem. Levando em conta a importância da família para a sociedade, esta investigação tem como foco a mediação, como procedimento mais adequado para a resolução dos conflitos familiares. Integra a doutrina ética solidária que este autor tem desenvolvido desde o ano 2007, desta vez, sobre a promoção da cultura da paz nas relações marcadas pela afetividade.
There are issues that adversarial procedural formalism is not appropriate to address. In a context in which the conception of family is renewed, the comprehension of the access to justice is taken in tow, presupposing changes in the civil ritualistic and its methods of approach. Taking into account the importance of the family to society, this research focuses on mediation, as the most appropriate procedure for the resolution of family conflicts. It is part of the solidary ethical doctrine that, since 2007, this author has been developing, this time, on the promotion of the culture of peace in relationships marked by affection.
