Abstract(s)
O presente trabalho está inserido no campo de estudos da Criminologia e do Direito Penal e tem como objetivo analisar a incidência do crime de Dano Emocional nas relações de trabalho, tipificado pela norma 14.188/21 no Brasil.
A pandemia mundial do Covid-19 trouxe modificações importantes nas relações trabalhistas, por vezes o ilícito suportado pela vítima não se enquadra no âmbito do assédio moral. Assim, através de pesquisa jurisprudencial, buscou-se analisar a efetividade da norma penal no combate a condutas ilícitas que lesionam a mulher em seu exercício laboral. No percurso metodológico traçado, com base na hermenêutica filosófica de Gadamer, foi possível verificar que a inovação legislativa confere maior alcance protetivo, ampliando o círculo normativo de assistência à mulher.
This paper is inserted in the field of studies of Criminology and Criminal Law and aims to analyze the incidence of the crime of Emotional Damage in labor relations, typified by the Law 14.188/21 in Brazil. The world pandemic of Covid-19 has brought important changes in labor relations, sometimes the illicit borne by the victim does not fit in the harassment moral Law. Thus, through jurisprudential research, we sought to analyze the effectiveness of the criminal norm in combating illicit conduct that injures women in their work. In the research, using as path Gadamer’s philosophical hermeneutics, it was possible to verify that the legislative innovation confers greater protective scope, expanding the normative circle of assistance to women.
