| dc.description.abstract | O presente trabalho tem como objetivo principal através do caso Homeniuk abordar a imigração em Portugal e analisar a observância dos direitos humanos nas políticas de admissão de imigrantes no país. Para isso, investiga-se as razões pelas quais as migrações acontecem e como a globalização influencia o fenômeno migratório. Para tanto, são analisados os dados do fenômeno, o fluxo migratório atual em Portugal e no mundo, a forma como a globalização atua no trânsito internacional de pessoas, influenciando-as na decisão de deslocarem-se, bem como a decisão dos Estados em receberem ou não imigrantes, avaliando o conflito existente entre liberdade de locomoção e soberania estatal. O estudo expõe também uma visão geral acerca da estrutura normativa internacional e local de proteção ao imigrante, discorrendo acerca dos tratados internacionais de proteção ao imigrante, com destaque na atuação da ONU para a salvaguarda dos direitos humanos. Em seguida, é avaliada a legislação portuguesa sobre imigração e os direitos dos imigrantes. Ademais, são apresentadas informações sobre o Serviço de Imigrantes e Fronteiras (SEF), o Centro de Instalação Temporária (CIT) e os Espaços Equiparados a Centro de instalação temporária (EECIT). Por fim, em ordem cronológica, apresenta-se o caso Ihor Homeniuk e, através de uma análise crítica, são elencadas as principais violações de direitos humanos ocorridas, os desdobramentos do caso e o impacto que o caso gerou no direito das migrações em Portugal. | pt_PT |
| dc.description.abstract | This master's dissertation has as a main objective to analyze immigration in Portugal through Ihor Homeniuk's case to verify the enforcement of human rights in the immigration's admission policies in Portugal. It aims to investigate the reasons why migration happens, as well how the globalization influences the phenomenon of immigration. It has been studied the data on the immigration and researched how globalization affects the international transit of people, how this influences the decision of people to move, as well as the decision of States to receive or not to receive immigrants. It will be analyzed the migratory flows in Portugal and in the world and the numbers of immigration flows. to analyze the conflict between freedom of movement and state sovereignty and how they are impacted by international treaties. Continuing the study, presenting an overview of the international and local regulatory framework for immigrant protection, discussing international treaties for the protection of immigrants and highlighting the UN's role in safeguarding human rights. Then, discuss the overview of Portuguese immigration legislation, emphasizing rights in constitutional and infraconstitutional legislation. Making an expatiating about the Temporary Center of Installation (CIT), about the space equates to Temporary Center of Installation (EECIT) and presenting the main aspects of the Immigrants and Borders Service. Ending with a chronological resume of Ihor Homeniuk's case and then a present a critical analysis listing the main human rights violations that occurred, the developments of the case and the impact on Portuguese migration law. | pt_PT |
