- A incapacidade civil dos Índios no Brasil: medida de proteção ou de exclusão?Publication . Xavier, Marinêz de Oliveira; Xavier, José Francisco; Cardoso, João CasqueiraIn order to identify the encoding process of the legal situation of the indigenous ethnic group in the Brazilian, with special emphasis on the legal capacity of these levels, we identified a number of citizens considered, specifically 350,438 persons, who in their day-to-day contact and form part of the whole society in the making of the various legal transactions. As a consequence of this fact, a number of important issues are inevitable, such as the validity of the performance of legal activities by these citizens. Because of loopholes, which legislation applies? What parameter should be used to establish the degree of legal capacity of a person belonging to an indigenous group? Last but not the least, the conceptual confusion in the legislation itself when dealing with “forest” population and “Indians” is an extra factor of complexity, with potential impact on the status of the studied citizens and may question whether they are actually subject to protection or discrimination.
- Polícia e escola em três países: como se estabelecem as pontes?Publication . Ugolini, Edna; Gomes, Candido; Cardoso, João CasqueiraA Cátedra UNESCO de Juventude, Educação e Sociedade da Universidade Católica de Brasília realizou pesquisa sobre a segurança escolar em quatro escolas públicas do Distrito Federal, em parceria com o Ministério Público do Distrito Federal e Territórios (MPDFT), incluindo a participação do policial. Será que o policial favorece a segurança e proteção de todos na escola ou contribui para o aumento da violência? Como diretores, professores, alunos, membros do Conselho de Segurança Escolar (CSE) avaliam a atuação do policial na escola? A pesquisa qualitativa e quantitativa teve entrevistas com quatro diretores, oito membros do CSE e sete policiais, grupos focais com ao todo 73 alunos, questionários aplicados a 99 professores e 615 alunos, em quatro escolas da rede pública incluídas entre as mais violentas no Brasil. Os participantes, inclusive os policiais, foram unânimes ao afirmar que a presença do agente na escola é importante para combater a violência, principalmente quando há relacionamento de amizade e confiança entre os policiais, a direção da escola, os alunos e os seus respectivos pais. Observou-se que o policial em vários casos se assimilou ao ambiente educativo, participando das atividades escolares e executando também funções pedagógicas voltadas à segurança escolar. O caso brasileiro, em Estado Federativo, é comparado com as relações entre polícias e sistemas escolares em Portugal e na França, ambos Estados unitários. A experiência do Brasil se distingue pela informalização relativa das relações sociais quando o policial interage por mais longo tempo com uma determinada escola. Desse modo, as normas burocráticas podem ser modificadas em virtude de características sócio-culturais.--- The UNESCO Chair of Youth, Education and Society at the Catholic University of Brasilia developed research project about school safety issue in four public schools of the Federal District, in partnership with the Public Prosecutor’s Office of the Federal District and Territories (MPDFT), including the involvement of police. Will the police promote safety and security for all in school or does he contribute to the increase in violence? As principals, teachers, students, how do members of the Safety School Board assess the role of police at school? This board conducted qualitative and quantitative research interviews with four officers, eight members of the board and seven police officers, focus groups with 73 students, questionnaires applied to 99 teachers and 615 students in four schools in the public considered among the most violent in Brazil The participants, including police officers, were unanimous in saying that the police presence in school is important to combat violence, especially when there is relationship of friendship and trust between the police, the direction of the school, pupils and their parents. It was observed that the police officers were well assimilated into the educational environment, participating in the school running also with functions aimed at teaching school safety. The case of Brazil, a federative state, is compared to the relations among police and school systems in Portugal and France, both unitary states. The Brazilian experience is different in the sense that social relations become more flexible and less formal whenever the police agent interacts in a school for a long time. Therefore, socio-cultural features may change bureaucratic rules.
