| dc.description.abstract | A proteção da dignidade da pessoa humana constitui um princípio estruturante do Estado de direito democrático, estando consagrado na Constituição da República Portuguesa, nomeadamente no seu art [1º], que estabelece a dignidade da pessoa humana como base da República (Constituição da República Portuguesa, 1976). Ainda que privados da liberdade, os reclusos mantêm os seus direitos, os quais devem ser assegurados durante a execução da pena. O presente projeto tem como principal objetivo analisar as perceções relativas à garantia das condições de vida e ao cumprimento dos direitos humanos em contexto prisional feminino, procurando compreender de que forma a realidade prisional é vivida e interpretada pelas reclusas e pelos técnicos e guardas prisionais. Deste modo, o projeto encontra-se dividido em duas partes principais. A primeira corresponde ao enquadramento teórico, no qual será abordado o sistema prisional, a reinserção social, as especificidades das mulheres reclusas, os direitos humanos relevantes para o contexto prisional e ainda a realidade atual em Portugal. A segunda parte consiste na apresentação de uma proposta de investigação de natureza qualitativa, recorrendo à realização de entrevistas semi-estruturadas a reclusas e a técnicos e guardas do Estabelecimento Prisional de Santa Cruz do Bispo Feminino, com o objetivo de analisar as perceções relativas à garantia das condições de vida e ao [cumprimentos] dos direitos humanos em contexto prisional. | dc.description.abstract | The protection of human dignity is a fundamental principle of the democratic rule of law, enshrined in the Constitution of the Portuguese Republic, specifically in Article 1, which establishes human dignity as the basis of the Republic (Constitution of the Portuguese Republic, 2005). Even when deprived of their liberty, prisoners retain their rights, which must be guaranteed during the execution of their sentence. The main objective of this project is to analyze perceptions regarding the guarantee of living conditions and the fulfillment of human rights in a female prison context, seeking to understand how prison reality is experienced and interpreted by inmates and by prison staff and guards. Thus, the project is divided into two main parts. The first corresponds to the theoretical framework, in which the prison system, social reintegration, the specificities of female prisoners, human rights relevant to the prison context, and the current reality in Portugal will be addressed. The second part consists of the presentation of a qualitative research proposal, using semi-structured interviews with female prisoners and technicians and guards from the Santa Cruz do Bispo Women's Prison, with the aim of analyzing perceptions regarding the guarantee of living conditions and the fulfillment of human rights in a prison context. This way, the aim is to contribute to a more in-depth reflection on the reality of female prisons in Portugal, linking the legal framework with the challenges of social reintegration and the perceptions of the different stakeholders in the prison system. | eng |
