O contributo e envolvimento dos psicólogos da justiça no aparelho judiciário tem vindo a crescer ao longo dos últimos anos, algo que parece resultar da maior aceitação da Psicologia como ciência, reconhecendo-se a importância da sua aplicabilidade no domínio judicial.
A presente dissertação é constituída por dois artigos científicos e pretende analisar a atuação dos psicólogos da justiça, em sede de tribunal, através da perspetiva de magistrados portugueses.
O primeiro artigo apresenta uma revisão da literatura científica, nacional e internacional, acerca do tema em questão. Neste trabalho foram analisados diferentes aspetos (ex.: instrumentos legais existentes sobre a matéria da proteção da criança e adolescente e da inquirição dos mesmos em sede de tribunal; a presença de crianças e jovens e a forma como eles sentem a passagem pelo sistema de justiça; as relações entre a psicologia e o direito; as aplicações da psicologia da justiça; a forma como a comunidade científica tem apostado em melhorar as metodologias que são aplicadas em diligências de inquirição com crianças e adolescentes). Com esta revisão foi possível concluir que tanto a comunidade científica como os legisladores estão atentos às capacidades que os psicólogos da justiça possuem e à ajuda que podem trazer ao sistema de justiça.
O segundo artigo versa sobre o estudo empírico, o qual procurou analisar a perceção que 39 magistrados judiciais e 6 magistrados do ministério público possuem acerca da presença do psicólogo em sede de tribunal. Foi distribuído um questionário em versão on-line pelas comarcas portuguesas responsáveis por matérias criminais e/ou de família e menores. As análises conduzidas aos dados recolhidos permitem concluir que os magistrados reconhecem a qualidade da formação dos psicólogos, a importância do seu trabalho, bem como a amplitude da sua aplicação. Contudo, exibiram uma certa resistência em aceitar indicações diretas destes profissionais, sobre a forma como o magistrado se deve dirigir à criança que necessita de inquirir.
A presente dissertação procura, desta forma, constituir mais um contributo para o aumento do conhecimento nesta área de forma a promover práticas mais amigáveis ao nível da audição da criança e do adolescente em sede tribunal.
The role of justice psychologists in court has been growing over the last few years. The acceptance of psychology as a science and the recognition of its applicability have enabled its professionals to broaden their scope of action. The present dissertation is made up of two scientific articles and intends to analyze the performance of the psychologists of justice, in court, through the perspective of portuguese magistrates. The first article presents a revision of the nacional and international cientific literature, about the theme in question. Diferent aspects were analysed in this work (ex.: legal existent instruments about the protection of the child and adolescence and their hearing in court of law; papers about the presence of children ang young people in court of law and how they feel their passage across the justice system; the relations between psychology and law; and the way the cientific community has been working to improve the methods applied in children and adolescence hearings. These revisions allowed us to conclude that both the scientific community and legislators are aware of the capabilities that justice psychologists possess and the help they can bring to the justice system. The second article is an empirical study, where we will analyze the perception that 39 judicial magistrates and 6 magistrates of the public prosecutor have, of the presence of the psychologist in court. A questionnaire was distributed in an online version by the portuguese counties responsible for criminal and / or family and juvenile matters. Based on the collected data, it is possible to conclude that magistrates recognize the quality of the training of psychologists, recognize the importance of their work, and the extent of their application, but are still reluctant to receive direct indications from these professionals, about the way that the magistrate should address the child who needs to inquire. The present dissertation intents to be another contribute to the knowledge that we have in this área, in order to promote more frendly like practices, in children and adolescence hearings.
