O presente trabalho procurou analisar determinadas noções sociais referentes à Justiça Restaurativa no caso da pena alternativa de prisão domiciliária. O principal objetivo esteve ligado a percepção das vivências que os participantes experimentaram durante o cumprimento da pena em regime de permanência na habitação, buscando ainda distinguir e entender a visão dos participantes relativo a múltiplos aspectos da Justiça Restaurativa, sobretudo àquelas ligadas a insatisfação com o atual modelo de sistema de Justiça Tradicional e a definição de razões que os levaram a utilizar (ou não) a Justiça Restaurativa. Em razão dos escassos estudos nesta área, é de todo considerável e importante refletir e entender este fenómeno. Foi definido como centrais objetivos tentar perceber quais os conhecimentos e opiniões dos reclusos sobre a prisão domiciliária e sobre a justiça restaurativa; Tentar depreender quais são os efeitos causados pelo cumprimento da pena em regime de permanência na habitação e o quanto isso afeta a qualidade de vida do recluso; Tentar compreender qual a utilização que os reclusos poderão fazer da pena de prisão domiciliária em conjunto com ferramentas da justiça restaurativa e quais são os pontos que podem levar ao seu sucesso ou insucesso. Para a obtenção destes objetivos, o presente estudo teve uma abordagem mista, com método de investigação de caráter exploratório-descritivo e qualitativo, com a realização de entrevistas semi-estruturadas; Além do método teórico bibliográfico, se utilizando de material bibliográfico, na condição de explorar o estudo qualitativamente, pois o pesquisador que utiliza o método bibliográfico como base para a sua pesquisa acaba descobrindo as teorias já existentes e, além disso, ele as inova, contraria, concorda e crítica. No presente estudo foi manuseada a técnica da entrevista de investigar, aplicada no total de 10 indivíduos. Os resultados apontam para que a maioria dos entrevistados não participou de nenhum programa de reinserção social e não conhece nenhuma prática restaurativa, além de vivenciarem efeitos negativos da privação da liberdade, sendo assim não estão satisfeitos com os serviços da Justiça Tradicional. O desconhecimento do conceito da Justiça Restaurativa é um dos dados mais relevantes do estudo: os participantes demonstram não conhecer os conceitos e nem os seus efeitos positivos. Concluiu-se que a Justiça Restaurativa, desde que bem elaborada, tendo os responsáveis pela sua implementação consciência dos problemas e dificuldades que terão de ser enfrentados e ainda a necessidade de abordar o tema nas escolas e nas universidades, assim como em ações de formação, pode ser uma ferramenta bastante útil para reduzir o mal causado e para aumentar a soberania no controle dos conflitos entre pessoas, porém vamos observar que a aplicação da mesma não é realizada.
The present work sought to analyze certain social notions referring to Restorative Justice in the case of the alternative sentence of house arrest. The main objective was linked to the perception of the experiences that the participants experienced during the execution of the sentence in a regime of permanence in the housing, still seeking to distinguish and understand the vision of the participants regarding multiple aspects of Restorative Justice, especially those related to dissatisfaction with the current situation/model of the Traditional Justice system and the definition of reasons that led them to use (or not) Restorative Justice. Due to the few studies in this area, it is quite considerable and important to reflect and understand this phenomenon. It was defined as central objectives to try to understand the knowledge and opinions of inmates on house arrest and on restorative justice; Trying to understand what are the effects caused by serving the sentence in a stay-at-home regime and how much this affects the inmate's quality of life; Trying to understand what use inmates can make of house arrest in conjunction with restorative justice tools and what are the points that can lead to their success or failure. To obtain these objectives, the present study had a mixed approach, with an exploratory-descriptive and qualitative research method, with semi-structured interviews; In addition to the bibliographic theoretical method, using bibliographic material, on condition of exploring the study qualitatively, because the researcher who uses the bibliographic method as a basis for his research ends up discovering existing theories and, in addition, he innovates them, contradicts, agree and criticize. In the present study, the investigation interview technique was used, applied to a total of 10 individuals. The results show that the majority of respondents did not participate in any social reintegration program and do not know any restorative practices, in addition to experiencing negative effects of deprivation of liberty, so they are not satisfied with the services of Traditional Justice. The lack of knowledge of the concept of Restorative Justice is one of the most relevant data of the study: the participants demonstrate that they do not know the concepts or their positive effects. It was concluded that Restorative Justice, as long as it is well designed, with those responsible for its implementation being aware of the problems and difficulties that will have to be faced and also the need to address the issue in schools and universities, as well as in training actions, it can be a very useful tool to reduce the harm caused and to increase sovereignty in the control of conflicts between people, however we will observe that the application of the same is not carried out.
