A prostituição feminina: uma realidade social e jurídica

Abstract(s)
O corpo assume um papel primordial nas vivências quotidianas de todo o ser humano. É através do corpo que os indivíduos exploram e experienciam o mundo à sua volta. O tema da prostituição representa uma das matérias mais complexas e controversas na Doutrina e Jurisprudência. Existem, inclusivamente, autores que defendem a sua inconstitucionalidade devido, não apenas à difícil identificação do bem jurídico, como pelo facto de o mesmo tutelar valores morais. Nesse sentido, este trabalho realça a relevância jurídica da prostituição feminina, em Portugal, refletindo sobre a necessidade de regulamentação e o seu reconhecimento como atividade profissional. Ao longo deste trabalho é, também, distinguido o conceito de prostituição, identificando as diversas formas de promoção desta prática. Reflete-se, também, sobre um conjunto de estratégias emocionais e comportamentais que parecem mediar as vivências e auxiliar as mulheres durante o seu trabalho, as diversas razões sociais e económicas que levam à prostituição, a problemática da dignidade humana e a tutela dos direitos, bem como a abordagem social e os sujeitos envolventes. Para além da componente teórica, este Projeto, tem também uma parte prática para uma melhor compreensão desta temática, tendo sido, elaborado um questionário com o objetivo de interagir com algumas destas trabalhadoras do sexo e perceber melhor as suas dificuldades, receios e aspirações.
The body assumes a primordial role in the daily experiences of the whole human being. It is through the body that individuals explore and experience the world around them. The prostitution issue represents one of the most complex and controversial subjects in the Doctrine and Jurisprudence. There are even authors who defend their unconstitutionality, due not only to the fact that it is difficult to identify the juridical good, but also to the fact that they represent some moral values. In this sense, this document highlights the legal relevance of female prostitution in Portugal, reflecting on the need for regulation and its recognition as a professional activity. Throughout this document the concept of prostitution is also distinguished, identifying the different ways of promoting this practice. It also reflects on a set of emotional and behavioral strategies that seem to mediate the experiences and help women during the practice of prostitution, the various social and economic reasons that lead to prostitution, the issue of human dignity and the protection of rights, as well as the social approach and the surrounding subjects. For a better understanding of this theme, a questionnaire was also prepared with the objective of interacting with some of these sex workers to better understanding their difficulties, fears and aspirations.
