| dc.description.abstract | O presente trabalho buscou investigar as percepções dos magistrados do sistema de justiça criminal da Comarca de São Luís, no Estado do Maranhão, no Brasil, acerca do crime violento. O objetivo principal consistiu em identificar a relação entre as convicções particulares dos magistrados e as representações sobre o crime violento por meio das visões jurídicas expressas nas suas opiniões e práticas profissionais. Em segundo plano questionou-se em que medida tais percepções se refletem nos posicionamentos jurídicos adotados pelos juízes. Para atingir os citados objetivos fez-se uso da técnica de entrevista de pesquisa qualitativa denominada “entrevista em profundidade”, realizadas na Comarca de São Luís/MA com 6 (seis) magistrados do Sistema de Justiça Criminal. Os inquiridos foram escolhidos numa amostra por conveniência, não-aleatória e, justificadamente, dentre magistrados que atuam em varas criminais da Comarca de São Luís. Os resultados apontam para a existência de uma relação entre as convicções pessoais e as profissionais dos magistrados pesquisados, sendo estas últimas influenciadas pelas primeiras. À pergunta sobre se a construção da identidade profissional interfere em suas abordagens teóricas, constatou-se a influência decisiva da visão jurídica na definição de crime violento, vislumbrando-se, em regra, a predominância de certos tipos penais como parâmetros à caracterização do fenómeno. A presente pesquisa pareceu contribuir com a formação de um conhecimento científico sobre o tema, ainda pouco estudado, das percepções dos magistrados sobre a realidade social e dos problemas com os quais operam, e sobre os desdobramentos de suas experiências na percepção e atuação profissional. | pt_PT |
| dc.description.abstract | The present work sought to investigate the perceptions of the magistrates of the criminal justice system of the District of São Luís, in the State of Maranhão, Brazil, on violent crime. The main objective was to identify the relationship between the particular convictions of magistrates and representations of violent crime through the legal views expressed in their opinions and professional practices. In the background, the question was raised to what extent these perceptions are reflected in the legal positions adopted by the judges. In order to reach these objectives, the qualitative research interview technique was called "in-depth interview", and empirical research was carried out in the São Luís/MA with 6 (six) judges from the Criminal Justice System. The respondents were chosen in a sample for convenience, not random and justifiably, among magistrates who work in criminal courts of the District of São Luís. The results point to the existence of a relationship between the personal and professional convictions of the investigated magistrates, the last ones being influenced by the first ones. To the question of whether the construction of professional identity interferes in its theoretical approaches, the decisive influence of the juridical view in the definition of the violent crime was detected, with a general view of the prevalence of certain criminal types as parameters for the characterization of the phenomenon. The present research contributes to the formation of a scientific knowledge about the question, still little studied, of asking the perceptions of the magistrates, in general, about the social reality and the problems with which they operate. | pt_PT |
