| dc.description.abstract | O menor que comete fatos tipificados pela lei como crime tem que ter garantidos os seus direitos, e de modo a prevenir que o mesmo sinta os efeitos estigmatizantes da aplicação de uma medida tutelar educativa, é essencial que a premissa de todo o seu processo seja sempre a reeducação e a ressocialização na comunidade. Deste modo, tendo sempre o interesse do menor como fator prioritário na intervenção, considerou-se relevante aferir qual a experiência dos profissionais judiciais, no caso, os advogados que representam menores em processos tutelares educativos. Para a recolha desses dados, foi realizado um questionário online, com a finalidade de entender quais os maiores desafios que estes profissionais sentem no processo de representação do menor, qual a formação que têm e a respetiva importância que dão aos diversos tipos de especialização, assim como à qualidade da entrevista e a importância que atribuem em conhecer o contexto social, económico e familiar do menor. A amostra, constituída por 99 advogados com experiência em processos tutelares educativos, demonstra uma grande valorização da maioria no que concerne aos fatores sociais e familiares do menor, tal como a importância de conduzir uma entrevista cuidada e adaptada às necessidades do mesmo, no entanto, não deixam de apresentar opiniões discrepantes noutro tipo de questões, como é o caso da importância que atribuem à formação e especialização. Assim, com este estudo pretende-se sensibilizar para a importância da formação e da especialização dos advogados nas distintas áreas da delinquência juvenil, de forma a colmatar as dificuldades apresentadas pelos mesmos e garantir que os direitos dos menores sejam promovidos e assegurados de forma eficaz. | pt_PT |
| dc.description.abstract | Juveniles who commit actions typified by the law as a crime must have their rights guaranteed, and in order to prevent them from feeling the stigmatizing effects of the application of an educational tutelary measure, it is essential that the premise of their entire process is always re-education and re-socialization in the community. Thus, always having the interest of the minor as a priority factor in the intervention, it was considered relevant to assess the experience of legal professionals, in this case, lawyers who represent minors in educational tutelary processes. For the collection of this data, an online questionnaire was carried out, in order to understand what are the biggest challenges that these professionals feel in the process of representing the minor, what training they have and the respective importance they give to the different types of specialization, thus as to the quality of the interview and the importance they attach to knowing the social, economic and family context of the minor. The sample, consisting of 99 lawyers with experience in educational tutelary processes, demonstrates a great appreciation of the majority when it comes to the minor's social and family factors, such as the importance of conducting a careful interview adapted to the child's needs, however, they do not fail to present differing opinions on other types of issues, such as the importance they attach to training and specialization. Thus, this study is intended to raise awareness of the importance of training and specialization of lawyers in the different areas of juvenile delinquency, in order to overcome the difficulties presented by them and ensure that the rights of minors are effectively promoted and ensured. | pt_PT |
