Este trabajo analiza las crisis carcelarias en América Latina y su impacto en los derechos humanos de las personas privadas de la libertad. El objetivo principal fue analizar las crisis carcelarias y el impacto que generan en las personas privadas de la libertad en diferentes países de la región, con base en el conocimiento del contexto de las crisis carcelarias en América latina, su evolución al igual que los factores que agravan esta situación como lo son el hacinamiento, las condiciones de vida deshumanas y la violencia. Este análisis se basó en las evidenciar las condiciones de los sistemas penitenciarios de la región, los cuales no llegan a cumplir los estándares internacionales de tratados como lo son las Reglas Mandela y la Convención Americana sobre los Derechos Humanos, así tratando con la legislación internacional y entendiendo los conceptos de los derechos humanos y los derechos de las personas privadas de la libertad. Mediante el análisis de las situaciones geográficas, demográficas y políticas, estos factores resultan influyentes en los sistemas penitenciarios, y enfocado en tres países de la región como lo son Ecuador, El Salvador y Venezuela. Finalmente se consideró la influencia de las organizaciones internacionales al respecto de las violaciones de derechos humanos, los cuales se encargan de la documentación y visualización de las violaciones donde organizaciones como Human Rights Watch y Amnistía Internacional dan su postura ante estas violaciones, la presión internacional generada y las recomendaciones que dan a los Estados, junto a la cooperación técnica y visitas humanitarias dieron a conocer el trabajo que tienen estas organizaciones, y con lo cual también demuestran los límites y desafíos dentro de la región.
This paper analyzes prison crises in Latin America and their impact on the human rights of persons deprived of liberty. The main objective was to analyze prison crises and the impact they generate on persons deprived of liberty in different countries of the region, based on the knowledge of the context of prison crises in Latin America, their evolution as well as the factors that aggravate this situation such as overcrowding, inhumane living conditions and violence. This analysis was based on the evidence of the conditions of the prison systems in the region, which do not meet the international standards of treaties such as the Mandela Rules and the American Convention on Human Rights, as well as dealing with international legislation and understanding the concepts of human rights and the rights of persons deprived of their liberty. Through the analysis of geographic, demographic and political situations, these factors are influential in the penitentiary systems, focusing on three countries in the region such as Ecuador, El Salvador and Venezuela. Finally, the influence of international organizations regarding human rights violations was considered, which are in charge of documenting and visualizing violations where organizations such as Human Rights Watch and Amnesty International give their position on these violations, the international pressure generated and the recommendations they give to the States, along with technical cooperation and humanitarian visits, which showed the work of these organizations, and with which they also demonstrate the limits and challenges within the region.
