Mesmo dentre os avanços na elaboração do ordenamento jurídico brasileiro, verifica-se ainda algumas dificuldades quando se trata da efetiva aplicabilidade. Esta pesquisa é voltada para a legislação que regulamenta a Educação Inclusiva no Brasil, bem como sua aplicabilidade. Delimitar-se-á às Escolas de Ensino Fundamental localizadas nos Municípios de Santana e Serra do Navio, no Estado do Amapá, ao Norte do Brasil. Para fins de efetiva aplicabilidade desse ordenamento, esta pesquisa sugere uma investigação nas Unidades de Ensino dos Municípios supracitados, bem como junto às famílias desses educandos, através de entrevistas com professores, supervisores, diretores, famílias e os próprios alunos, respeitadas as limitações de cada um. Daí se extrai a problemática deste trabalho: Existe coerência entre a legislação e sua aplicabilidade? De acordo com esta proposta, os alunos com deficiência serão verdadeiramente protegidos pela eficácia do ordenamento. Assim, o objetivo geral a que se propõe a Dissertação a seguir desenvolvida será o de verificar como se constitui a exigência jurídica quando se trata de suprir as necessidades dos alunos com deficiência, bem como atenuar as desigualdades existentes. Lamentavelmente, algumas das propostas de proteção a esses educandos nem sempre são bem vistas como qualquer outra que vise atenuar as desigualdades sociais. Dentre os diversos métodos de abordagem, foi feito opção pela metodologia quantitativa, ao verificar instrumentos como questionários, visitas às instituições de ensino. Considerando os dados da pesquisa verificou-se incoerência parcial entre a previsão legal e sua efetiva aplicabilidade, o que será demonstrado quando da análise de dados. Os participantes terão assegurados a confidencialidade e segurança emocional, bem como a reciprocidade da investigação.
Even among the advances in the elaboration of the Brazilian legal system, there are still some difficulties when it comes to the effective applicability. That research is focused on legislation that regulates Inclusive Education in Brazil, as well as your applicability. It will be delimited Elementary Schools located in the cities of Santana and Serra do Navio in the State of Amapá in the North of Brazil. For the purposes of effective applicability of this order, this research suggests an investigation in the Teaching Units of the mentioned cities, as well as with the families of these students, through interviews with teachers, supervisors, principals, family and students themselves. From there the problem of this work is extracted: Is there consistency between legislation and is applicability? According to this proposal, students with disabilities will be truly protected by the effectiveness of order. Thus, the general objective proposed by the following Dissertation will be to verify how the legal system works when it comes to meeting the needs of students with disabilities, as well as alleviating existing inequalities. Unfortunately, some of the proposals to protect these students are not always regarded as any other that aims to mitigate social inequalities. Among the several methods of approach, the quantitative methodology was chosen, checking instruments such as questionnaires, visits to educational institutions. Considering the research data, there was a partial inconsistency between the legal provision and its effective applicability, which will be demonstrated when analyzing the data. Participants will be assured of confidentiality and emotional security, as well as the reciprocity of the investigation.
