Abstract(s)
A análise de processos sociais referentes a crianças institucionalizadas revela, regra geral,
que a configuração da família biológica como espaço ideal para o crescimento e
desenvolvimento de uma criança conduz, não raras vezes, a pareceres técnicos e decisões
judiciais que nos levam a problematizar os entendimentos em torno do conceito de Superior
Interesse da Criança.
O presente estudo, de carácter exploratório, recorre ao método qualitativo, com recurso à
análise documental e à entrevista em profundidade, mediante a aplicação de dois guiões
distintos: o Guião A, aplicado a três profissionais dedicados à área da família e menores; e o
Guião B, aplicado a uma família acompanhada por diferentes serviços da mesma área.
Em termos gerais, os resultados revelam práticas de intervenção reféns de um ideal de
família biológica, responsáveis pela institucionalização das crianças em causa por um
período largamente superior ao previsto pelo legislador.
The analysis of social processes concerning institutionalised children usually reveals that the assumption of the biological family as the ideal setting for a child’s growth and development, often leads to technical opinions and legal decisions that make us question the consensual views around the concept of the Best Interest of the Child. The present exploratory study is carried out through a qualitative methodology, using both documentary analysis and in-depth interview, conducted with two different scripts: script A, aimed at three Family and Child welfare professionals and script B, aimed at a family who is being assisted by services in the same field. All in all, the results show intervention procedures locked into an ideal of biological family, which make the period of the children´s institutionalization much longer than the one prescribed by the legislator.
