Abstract(s)
O presente projeto tem como objetivo expandir as competĆŖncias dos Julgados de Paz em Portugal, principalmente em razĆ£o da matĆ©ria, fazendo com que julguem crimes de menor gravidade e complexidade, nomeadamente, os que originam os pedidos de indemnização , enfatizando as particularidades e princĆpios destes tribunais, contribuindo para uma JustiƧa ainda mais cĆ©lere em Portugal, ao mesmo tempo, auxiliem positivamente na reinserção do indivĆduo em sociedade, resultando no descongestionamento dos tribunais convencionais.
Neste sentido, o projeto propƵe a realização de um programa de intervenção de nĆvel terciĆ”rio, com mĆ©todo predominantemente quantitativo, em que a amostra de modo geral Ć© baseada em todos os funcionĆ”rios dos Julgados de Paz em Portugal, operando o grupo como um todo. SerĆ£o elaborados inquĆ©ritos por questionĆ”rio, implementadas formaƧƵes aos oficiais de justiƧa, remodelaƧƵes e otimizaƧƵes no funcionamento destes tribunais e, aplicação da mediação penal. NĆ£o obstante, serĆ” necessĆ”ria a colaboração entre Criminólogos, Juristas, JuĆzes, Mediadores Penais, Arquitetos e Construtores Civis e, de igual modo, disponibilizados orƧamentos.
Após a realização deste programa, serĆ£o esperados resultados positivos no que toca Ć instauração da nova competĆŖncia em razĆ£o da matĆ©ria e, todas as vantagens que esta renovação proporcionarĆ”, desde a celeridade processual e o descongestionamento dos tribunais judiciais, Ć reinserção do cidadĆ£o em sociedade, usufruindo, como dito anteriormente, das particularidades excecionais destes tribunais, incluindo o baixo custo processual, o princĆpio da informalidade, o carĆ”ter voluntĆ”rio da mediação penal e, a conciliação em sede de audiĆŖncia de julgamento.
The aim of this project is to extend the competences of the Justice of the Peace Courts in Portugal, especially in terms of subject matter, so that they can judge less serious and complex crimes, namely those that give rise to compensation claims (Article 9(2) of Law No. 54/2013 of 31 July 2013), emphasising the particularities and principles of these courts, contributing to even faster justice in Portugal, while at the same time positively helping to reintegrate individuals into society, thereby decongesting conventional courts. In this sense, the project proposes to carry out a tertiary-level intervention program, with a predominantly quantitative method, in which the sample is generally based on all the employees of the Justice of the Peace Courts in Portugal. Questionnaire surveys will be drawn up, training will be given to court clerks, the functioning of these courts will be remodelled and optimised, and criminal mediation will be applied. However, collaboration will be required between criminologists, jurists, judges, criminal mediators, architects and civil builders, and quotations will also be provided. Once this program has been carried out, positive results are expected with regard to the establishment of the new jurisdiction based on the subject matter and all the advantages that this renewal will provide, from procedural speed and decongestion of the courts to the reintegration of citizens into society, taking advantage, as previously stated, of the exceptional features of these courts, including the low procedural cost, the principle of informality, the voluntary nature of criminal mediation and conciliation at the trial hearing.
