Essa dissertação discute a responsabilidade Civil e Criminal do Notário e Registrador, mencionando os seus principais aspectos, destacando a Evolução Histórica da Atividade, princípios que regem a Atividade Notarial e Registral, o ingresso na atividade até a perda da delegação. No capítulo referente à responsabilidade civil é dado enfoque à questão da responsabilidade subjetiva do Notário e registrador, que se insere desde a efetivação dos seus atos e se estende também aos atos de seu prepostos. Se é enfatizado também a questão da responsabilidade Objetiva do Estado, no que tange a predominância das decisões dos Tribunais, pelos Atos lavrados pelo Notário e Registrador. Mostra-se como exemplos decisões dos Tribunais Brasileiros enfocando acerca da responsabilidade solidária, subsidiária e responsabilidade objetiva do estado pelos atos do Notário e Registrador. No campo da responsabilidade criminal, se é dado enfoque que o Notário e Registrador para efeitos criminais se equipara a Servidor Público, e nestes termos responde pelos tipos penais inseridos nos Crimes Contra a administração pública, sendo demonstrado com as figuras típicas inseridas nos artigos 312 À 325 do Código Penal Brasileiro, exemplos de casos verídicos e decisões jurisprudenciais que se enquadram no tipo penal.
This dissertation discusses the Civil and Criminal liability of the Notary and registrar, mentioning its main aspects, highlighting the Historical Evolution of the Activity, principles that govern Notarial and Registry Activity, entering the activity until the loss of the delegation. The chapter on civil liability focuses on the question of the subjective responsibility of the Notary and registrar, which is inserted since the realization of their acts and also extends to the acts of their representatives. If the question of the State's Objective responsibility is also emphasized, with regard to the predominance of the decisions of the Courts, for the Acts drawn up by the Notary and Registrar. Examples of decisions of the Brazilian Courts focusing on solidary, subsidiary and strict liability of the State for the acts of the Notary and Registrar are shown as examples. In the field of criminal responsibility, it is emphasized that the Notary and Registrar for criminal purposes equates to Public Servants, and in these terms is responsible for the criminal types inserted in Crimes Against the public administration, being demonstrated with the typical figures inserted in articles 312 À 325 of the Brazilian Penal Code, examples of true cases and jurisprudential decisions that fall under the penal type.
