A visão dos Julgados de Paz por parte do Tribunal Judicial: todos os trâmites legais para chegar a uma decisão em ambos os órgãos judiciais

| dc.description.abstract | A atual proposta aqui apresentada consiste em compreender os níveis de conhecimento que, tanto o Julgado de Paz, como o Tribunal Judicial, têm um sobre o outro sendo este estudo apresentado à Faculdade de Ciências Humanas e Sociais da Universidade Fernando Pessoa como parte dos requisitos para a obtenção do grau de licenciada em Criminologia. Este estudo tem como principal objetivo analisar os níveis de conhecimentos entre os dois órgãos judiciais, supramencionados, de modo a ajudar na proliferação dos Julgados de Paz e na diminuição das ações processuais interpostas no Tribunal Judicial. De modo a atingir tal objetivo, em primeiro lugar, indivíduos específicos, isto é, funcionários do Tribunal Judicial e do Julgado de Paz, neste caso, do Porto, seriam entrevistados, onde responderiam a perguntas abertas tanto sobre um, como o outro órgão judicial, de modo a podermos analisar o grau de conhecimento atual e as perceções do que estes têm um sobre o outro, e assim poder também compreender os que estes fariam de diferente para resolver os problemas atuais destes órgãos. Neste caso, o do Julgado de Paz é a falta de visibilidade e, consequentemente, um número inferior de ações processuais, já, o do Tribunal Judicial é haver demasiadas ações, relativamente, a crimes de pouca relevância, atrasando assim todo o processo. A escolha deste tema derivou-se ao facto de ter feito o meu estágio curricular no Julgado de Paz do Porto e Terras de Bouro e, por razões pessoais, ter um insight do Tribunal Judicial e sabendo os problemas que ambos atravessam, e também da falta de conhecimento dos funcionários do Tribunal Judicial em relação a este órgão Extrajudicial, achei pertinente a elaboração deste estudo de modo a poder auxiliar na proliferação dos Julgados de Paz e nas suas competências e, concludentemente, ajudar na resolução dos problemas destes, sendo que estão intrinsecamente ligados. | pt_PT |
| dc.description.abstract | The current proposal presented here is to understand the levels of knowledge that both the Justice of the Peace and the Judicial Court have about each other. This study is presented to the Faculty of Human and Social Sciences of Fernando Pessoa University as part of the requirements for obtaining a degree in Criminology. The main objective of this study is to analyze the levels of knowledge between the two judicial bodies, mentioned above, in order to help the proliferation of the Courts of Peace and the decrease of lawsuits brought before the Judicial Court. To achieve this objective, in the first place, specific individuals, that is, employees of the Judicial Court and of the Courts of Peace, in this case, of Porto, would be interviewed, where they would answer open questions both about one, and the other judicial body, so that we could analyze the degree of current knowledge and perceptions they have about each other. In this case, the problem with the Justice of the Peace is the lack of visibility and, consequently, a lower number of procedural actions, while the problem with the Judicial Court is that there are too many actions regarding crimes of little relevance, thus delaying the whole process. The choice of this theme derived from the fact that I did my curricular internship in the Porto Courts of Peace and, for personal reasons, have an insight of the Judicial Court and knowing the problems that both go through, and also the lack of knowledge of the Judicial Court employees in relation to this Extrajudicial organ, I found pertinent the elaboration of this study in order to assist in the proliferation of the Courts of Peace and in their competencies and, conclusively, help in the resolution of their problems, being that they are intrinsically linked. | pt_PT |
