O presente trabalho pretende refletir sobre a relação entre a privacidade e a legislação aprovada pela EU em matéria de luta contra o terrorismo. A escolha deste tema deve-se ao fato de ser um tema de especial interesse pessoal devido à complexidade da relação entre o direito à segurança e o direito à liberdade, tornando-se importante perceber como eles se relacionam numa lógica de combate ao terrorismo. Utiliza-se um método de análise documental.
Este projeto pretende analisar em que medida é que os direitos pessoais ficam comprimidos fruto das exigências securitárias e até que ponto poderão os Estados colocar esses mesmos direitos à prova.
This paper aims to reflect on the relationship between privacy and the legislation adopted by the EU in the fight against terrorism. The choice of this theme is due to the fact that it is a subject of special personal interest because of the complexity of the relationship between the right to security and the right to freedom, and it is important to realize how they relate in a counter-terrorism logic. A method of documentary analysis is used. This project intends to analyze the extent to which personal rights are compressed as a result of security requirements and the extent to which States can put those rights to the test.
