Abstract(s)
A presente dissertação analisa a metodologia adotada pela Associação de Proteção e Assistência aos Condenados (APAC) enquanto modelo institucional alternativo de execução penal, tendo como base empírica a experiência vivenciada na Unidade Masculina do interior do Triângulo Mineiro, em Minas Gerais. Inicialmente, toma-se a premissa de que a pena privativa de liberdade, em sua configuração tradicional, se revela ineficaz, desumana e estruturalmente seletiva. Desta feita, o trabalho tem como objetivo examinar em que medida a proposta apaqueana rompe, de fato, com os paradigmas excludentes do sistema carcerário convencional ou se reconfigura como instrumento simbólico de funcionalidade ao modelo punitivo vigente. A abordagem metodológica é qualitativa, de matriz crítica, com aplicação de entrevistas estruturadas para 100 (cem) recuperandos e análise de referencial bibliográfico, à luz de um referencial teórico correlatos à criminologia crítica, a política criminal, dos princípios fundamentais, da justiça restaurativa, direito penal e da sociologia do poder disciplinar. Após a implementação da metodologia supracitada, os resultados indicam que a APAC promove, na percepção dos recuperandos, práticas concretas de reconstrução subjetiva, valorização da dignidade humana, resgate de vínculos familiares e reconhecimento social, propondo o rompimento com o estigma da criminalidade. Mesmo, que doutro lado, envolto por tensões institucionais vinculadas à seletividade e restribilidade de ingresso, à hegemonia religiosa, à insuficiência estrutural, à opacidade da meritocracia e à dificuldade concreta de reintegração plena. Conclui-se que a APAC opera simultaneamente como espaço de ruptura e de normalização simbólica, exigindo leitura dialética e constante reavaliação de seus efeitos concretos sobre os sujeitos penalizados. Uma vez que a ausência de criticidade colocaria sob pena a instrumentalização da proposta como fachada humanista de legitimação do sistema penal seletivo. O trabalho sustenta, por logo, a necessidade de políticas públicas que ampliem o acesso à execução penal humanizada sem reproduzir filtros morais, estruturais, espirituais ou institucionais de pertencimento ou resistência, com o afã de tornar a dignidade não uma promessa, mas um ponto de partida irrenunciável da justiça criminal em um Estado democrático de Direito.
This dissertation analyzes the methodology adopted by the Association for the Protection and Assistance of Convicts (APAC) as an alternative institutional model for criminal execution, based on the empirical experience of the Men's Unit of Triângulo Mineiro, on Minas Gerais. Initially, the premise is that the custodial sentence, in its traditional configuration, is ineffective, inhumane and structurally selective. Therefore, the work aims to examine to what extent the APAC proposal actually breaks with the exclusionary paradigms of the conventional prison system or reconfigures itself as a symbolic instrument of functionality to the current punitive model. The methodological approach is qualitative, with a critical matrix, with the application of structured interviews with 100 (one hundred) convicts and analysis of bibliographic references, in the light of a theoretical framework related to critical criminology, criminal policy, fundamental principles, restorative justice, criminal law and the sociology of disciplinary power. After implementing the aforementioned methodology, the results indicate that APAC promotes, in the perception of the inmates, concrete practices of subjective reconstruction, valorization of human dignity, recovery of family ties and social recognition, proposing the breaking with the stigma of criminality. Even though, on the other hand, it is surrounded by institutional tensions linked to the selectivity and restrictiveness of entry, religious hegemony, structural insufficiency, the opacity of meritocracy and the concrete difficulty of full reintegration. It is concluded that APAC operates simultaneously as a space of rupture and symbolic normalization, requiring a dialectical reading and constant reassessment of its concrete effects on the penalized subjects. Since the lack of criticality would put under threat the instrumentalization of the proposal as a humanist facade of legitimization of the selective penal system. The work therefore supports the need for public policies that expand access to humane criminal execution without reproducing moral, structural, spiritual or institutional filters of belonging or resistance, with the aim of making dignity not a promise, but an irrevocable starting point for criminal justice in a democratic State under the rule of law.
