A participação da criança e do jovem no Tribunal está a tornar-se cada vez mais comum. Por esse motivo, torna-se fundamental que os seus representantes compreendam a relevância do seu papel para a experiência da criança e de jovem no sistema de justiça. Neste sentido, o presente estudo tem como principal objetivo perceber se existe preocupação por parte dos advogados no que concerne o bem-estar e conforto das crianças e jovens envolvidas em processos tutelares cíveis. A recolha de dados foi feita através da administração online de um questionário a uma amostra de 58 advogados com experiência em processos tutelares cíveis. Em termos de resultados, grande parte dos advogados evidenciou valorizar a participação da criança e do jovem em Tribunal destacando assim, a importância que os mesmos dão ao papel e à experiência dos menores no sistema de justiça e reconhecendo a opinião e os pontos de vista dos mesmos como uma das principais fontes de informação para a tomada de decisão. Contudo, constatou-se uma pouca procura por parte destes inquiridos em proceder com formações inerentes ao desenvolvimento da criança. O trabalho interdisciplinar foi outro tópico menos valorizado por estes profissionais. Assim, pretende-se com este estudo sensibilizar para a importância das formações inerentes à infância e aos estágios desenvolvimentais dos menores, bem como, para todos os aspetos mencionados ao longo deste estudo, por constituírem uma mais valia para salvaguardar e defender os direitos da criança.
Children’s participation in Court is becoming more common. For this reason, it is essential that their representatives understand the relevance they play in the experience children have in the justice system. This study has the main objective of understanding if there is a concern by laywers in the well-being and comfort of children involved in civil guardianship processes. Data collection was carried out through an online questionnaire with a sample of 58 lawyers with experience in civil protection proceedings. In terms of results, a large percentage of these lawyers showed they value the participation of children and adolescents in Court, highlighting the importance given to the role minors play and to their experience in the justice system and also recognizing the opinion and points of view of these minors as one of the main sources of information for decision making. However, there was little demand from these respondents to proceed with training regarding children’s development. Interdisciplinary work was another topic less valued by these professionals. Thus, the aim of this study was to raise awareness to the importance of training regarding the developmental stages of children and adolescents, as well as the importance laywers have as assets to protect and defend these children’s rights.
