Os Ăndices de criminalidade envolvendo violĂȘncia contra as mulheres no Brasil tĂȘm sido alarmantes, tendo aumentado no perĂodo de adoção de polĂticas pĂșblicas de contigenciamento e distanciamento social em decorrĂȘncia dos efeitos da pandemia ocasionada pelo coronavĂrus (COVID-19). Ainda que tenham sido editadas legislaçÔes protetivas que sĂŁo reconhecidas como avançadas por organismos internacionais, como por exemplo, a Lei Maria da Penha (2006), a problemĂĄtica ainda se mantĂ©m. O presente trabalho terĂĄ enfoque na violĂȘncia institucional e na violĂȘncia de gĂȘnero contra as mulheres no Brasil, que possuem uma estreita correlação, por decorrerem do mesmo contexto histĂłrico e social em que se pautou a construção da sociedade brasileira. Portanto, serĂŁo analisados aspectos histĂłricos, culturais e legais envoltos Ă violĂȘncia e cultura da submissĂŁo, bem como a necessidade de combate aos estereĂłtipos e estigmas que tem sido reproduzido em todas as esferas sociais e de poder. Para tanto, atravĂ©s da metodologia indutiva de anĂĄlise qualitativa e pesquisa bibliogrĂĄfica e explorativa, serĂŁo abordados os conceitos de gĂȘnero e violĂȘncia, a necessidade do estudo da vitimologia e, tambĂ©m, a (in) efetividade das leis nacionais de combate e repressĂŁo Ă violĂȘncia contra a mulher, expondo-se as polĂticas pĂșblicas adotadas pelo Brasil e a utilização do simbolismo penal como uma tentativa de conter aos anseios sociais por Justiça e redução da criminalidade.
The criminal indexes involving violence against women in Brazil are alarming, having it increased in the taking steps period of contingency public policies and social distancing due to the pandemic effects caused by coronavirus (COVID-19). Even though with the promulgation of protective laws recognized as advanced by international organizations, such as the Maria da Penha Law (2006), the problem still remains. The present work will focus on institutional and gender violences against women in Brazil, and as they are interconnected ones, arise from the same historical and social context on which the construction of Brazilian society was based. Therefore, historical, cultural and legal aspects involving violence and submission culture will be analyzed, as well the needs of combating stereotypes and stigmas that have been reproduced in all social and power spheres. For this purpose, through inductive methodology of qualitative analysis and bibliographical and exploratory research, the concepts of gender-based violence will be aproached, as well the need of the study of victimology and the (in) effectiveness of national laws to combat and repress violence against the woman, exposing the public policies adopted by Brazil and the use of penal symbolism as an attempt to contain the social aspirations for justice and crime reduction.
