Abstract(s)
A estrutura social é continuamente alterada pela franca evolução tecnológica com modificações geradoras de novos comportamentos, algumas vezes, nocivos. O desafio para o Direito e a Criminologia é investigar tais comportamentos inapropriados, mediante prevenção e punição de condutas tipificadas como criminosas. Dentre elas, destaque para a exposição não consentida de conteúdos íntimos, a qual vem crescendo vertiginosamente com a expansão do espaço virtual e suas múltiplas potencialidades, o que justifica a motivação deste estudo, cujo objetivo macro é analisar, de forma acurada, esses desvios de conduta. Metodologicamente, o estudo recorre ao método quanti-qualitativo, partindo, a princípio, de conceitos teóricos resultantes de pesquisa bibliográfica e de revisão de literatura. Sustenta-se a premissa hipotética de que a prática de divulgar conteúdos íntimos sem o consentimento da pessoa exposta representa, quase sempre, a assunção da violência de gênero em novo formato, haja vista que a maioria das vítimas é do gênero feminino.
The social structure is always altered by the great technological evolution. So, it changes some human behaviors and also generates new others, sometimes very harmful. The challenge for Law and Criminology and also for your professionals is to investigate such inappropriate behaviors, through prevention and punishment of conduct characterized as criminal. Among the new criminal behaviors, it is highlighted the non-consenting exposure of intimate content, which has been growing histrionically with the expansion of the virtual space and its multiple potentialities, which justifies the motivation of this study, whose macro objective is to analyze these great problems which affect the society. Methodologically, the study uses the quanti-qualitative method, starting with theoretical concepts resulting from bibliographical research and literature review. The hypothetical premise sustains that the practice of disseminating intimate content without the consent of the exposed person almost always represents the assumption of gender-based violence in a new format, given that the majority of victims are female.
