Foi criado uma estigmatização em torno dos homossexuais atribuindo uma condição depreciativa. Embora de acordo com diversos registros históricos, a homossexualidade sempre esteve presente na sociedade, não se sabe ao certo quando essa estigmatização começou. O padrão heteronormativo gera discriminação de homossexuais, reduz o indivíduo como algo que é moralmente defeituoso aos olhos dos outros e não está de acordo com o padrão social. O problema dessa estigmatização é o impulsionamento do heterossexismo ao falso direito ao preconceito, discriminação, violência, contra toda orientação sexual que não seja a heterossexual. Verificou-se que a violência oriunda do padrão heteronormativo, tem como influências: a religião que traz a ideia de pecado e que através das confissões obteve o controle social; o poder exercido pelo Estado que durante séculos recriminaram/recriminam a homossexualidade; os avanços da ciência que considerou por muitos anos a homossexualidade como uma patologia. Para analisar essa maldade do ser humano será apresentado as principais teses de filósofos consagrados como Foucault, e do psicanalista Freud. Também será abordado o contraponto de Hobbes e Rousseau em torno da questão do homem e sua maldade, demonstrando duas perspectivas filosóficas sendo a de Hobbes que determina a agressividade do homem, e a concepção rousseauniana que demonstras os fatores emocionais que interferem no desenvolvimento do indivíduo. Através de uma pesquisa qualitativa será demonstrado certos fenômenos comportamentais através da coleta de dados que expressam o grau de maldade da violência do ser humano. Maldade essa que foi amplamente debatida no Superior Tribunal Federal do Brasil ao julgar a Ação Direta de Inconstitucionalidade por Omissão uma vez que o país possui um cenário caótico em desfavor das pessoas LGBT, entretanto, não há nenhuma lei que forneça proteção e criminalize a homofobia. E diante a banalidade do mal homofóbico foi realizado um paralelo entre a noção de Hannah Arendt de banalidade do mal com a violência praticada contra pessoas LGBT. A tese Banalidade do Mal de Hannah Arendt foi uma das principais teses utilizadas na criminalização da homofobia e LGBTfobia no Brasil, entretanto pretende demonstrar se o brasileiro é um indivíduo, comum, banal, como Eichmann, fruto de uma sociedade homofóbica que pratica inconscientemente a violência.
A stigmatization around homosexuals was created, attributing a derogatory condition. Although according to several historical records, homosexuality has always been present in society, it is not clear when this stigmatization started. The heteronormative standard generates discrimination against homosexuals, reduces the individual as something that is morally defective in the eyes of others and is not in accordance with the social standard. The problem with this stigmatization is the promotion of heterosexism to the false right to prejudice, discrimination, violence, against any sexual orientation other than heterosexual. It was found that violence originating from the heteronormative pattern, has the following influences: the religion that brings the idea of sin and that through confessions obtained social control; the power exercised by the State that for centuries have reproached / condemned homosexuality; the advances in science that considered homosexuality as a pathology for many years. In order to analyze this evil of the human being, the main theses of renowned philosophers such as Foucault and the psychoanalyst Freud will be presented. Hobbes and Rousseau's counterpoint around the question of man and his wickedness will also be addressed, demonstrating two philosophical perspectives being Hobbes's that determines man's aggressiveness, and the Rousseaunian conception that demonstrates the emotional factors that interfere in the development of the individual. Through a qualitative research certain behavioral phenomena will be demonstrated through the collection of data that demonstrate the degree of evil violence of the human being. This evil was widely debated in the Superior Federal Court of Brazil when judging the Direct Action of Unconstitutionality by Default since the country has a chaotic scenario to the detriment of LGBT people, however, there is no law that provides protection and criminalizes homophobia. And in the face of the banality of homophobic evil, a parallel was drawn between Hannah Arendt's notion of banality of evil and the violence practiced against LGBT people. Hannah Arendt's Banality of Evil thesis was one of the main theses used in the criminalization of homophobia and LGBT phobia in Brazil, however it intends to demonstrate whether the Brazilian is an ordinary, commonplace person, like Eichmann, the result of a homophobic society that unconsciously practices violence.
