O presente projecto aborda a temática dos “casamentos de conveniência”, conduta sancionada em Portugal com pena de prisão máxima de 5 anos. Devido a este tema se encontrar explorado de forma superficial a nível científico, com a concretização desta investigação procura-se saber a extensão do fenómeno em Portugal e nos restantes Estados-Membros da União Europeia, os métodos e critérios presentemente usados para identificar estas uniões, o perfil dos indivíduos envolvidos, as principais dificuldades sentidas aquando a prova em Tribunal deste tipo de crime. Baseado em informação recolhida utilizando métodos qualitativos com este estudo espera-se obter uma melhor compreensão do tema “casamentos de conveniência” tanto a nível nacional como nos restantes países membros da União Europeia.
The main theme of the current project is “marriages of convenience”, a criminal conduct sanctioned in Portugal with imprisonment up to 5 years. Due to the fact that this subject is only superficially explored in a scientific level, by fulfilling the achievements proposed in this research it will be known the extent of this phenomenon in Portugal and in the other State-Members of the European Union, the methods currently used to identify these unions, the profile of those involved and the main difficulties felt when attesting this type of crime in court. With basis in information gathered using qualitative methods, a better understanding of the theme “bogus marriages” is expected in both Portugal and the rest of the members of the European Union.
