Esta tese tem como objetivo principal analisar as motivações que levaram mulheres a renunciar a processos criminais em trâmite no juizado responsável por julgar assuntos relacionados à violência doméstica e familiar contra a mulher, na cidade de Fortaleza, no estado do Ceará, Brasil. E, como objetivos específicos: traçar um panorama da questão, evidenciando, sobretudo, aspetos legais da prática da violência praticada contra a mulher de conformidade com a Lei Maria da Penha; caracterizar o tipo de violência sofrida e, dinâmicas abusivas; identificar os motivos inerentes à permanência na relação abusiva que se representa de forma criminal nos casos em que esta não lhes é facultada por tratar-se de ação pública incondicionada. A metodologia utilizada no estudo em questão, trata-se de um estudo empírico, através de uma entrevista semiestruturada, com o intuito de analisar as motivações que levaram mulheres a renunciar a processos criminais em trâmite no juizado responsável por julgar assuntos relacionados à violência doméstica e familiar contra a mulher, na cidade de Fortaleza, no estado do Ceará, Brasil. Numa análise geral, verifica-se que a violência tem início por motivos de ciúmes por parte de seus parceiros e vai aumentando na medida em que estes são catalogados como usuários de substâncias entorpecentes ou dependentes alcoólicos.
A escalada da violência tem início com agressões verbais e psicológicas as quais vão aumentando gradativamente até se chegar nas agressões físicas e culminando com a morte dessas mulheres por seus companheiros, caracterizando-se assim o crime de feminicídio. Que a existência de filhos, a esperança de mudança de comportamento de seus companheiros, a dependência financeira e emocional somadas ao medo e ao tabu do estigma que envolve as vítimas desse tipo de violência são os principais fatores identificados como os responsáveis pela desistência dos processos criminais abertos na Justiça por estas mulheres com o escopo de punir seus agressores. Dentre as vítimas que conseguem romper com o ciclo de violência, a maioria se declara traumatizada e evita buscar direitos decorrentes do término desse relacionamento a exemplo de direitos patrimoniais.
The main objective of this thesis is to analyze the motivations that led women to renounce criminal cases in progress in the court responsible for judging matters related to domestic and family violence against women, in the city of Fortaleza, in the state of Ceará, Brazil. And, as specific objectives: to draw an overview of the issue, highlighting, above all, legal aspects of the practice of violence against women in accordance with the Maria da Penha Law; characterize the type of violence suffered and abusive dynamics; identify the reasons inherent to the permanence in the abusive relationship that is represented in a criminal manner in cases where this is not allowed to them because it is an unconditional public action. The methodology used in the study in question, it is an empirical study, through a semistructured interview, in order to analyze the motivations that led women to renounce criminal cases in progress in the court responsible for judging matters related to violence family and domestic violence against women, in the city of Fortaleza, in the state of Ceará, Brazil. In a general analysis, it appears that violence begins because of jealousy on the part of their partners and increases as they are classified as users of narcotic substances or alcoholics. The escalation of violence begins with verbal and psychological aggressions, which gradually increase until reaching physical aggression and culminating in the death of these women by their partners, thus characterizing the crime of femicide. That the existence of children, the hope of changing the behavior of their partners, the financial and emotional dependence added to the fear and the taboo of the stigma that surrounds victims of this type of violence are the main factors identified as those responsible for giving up on criminal proceedings opened in court by these women with the scope of punishing their aggressors. Among the victims who manage to break the cycle of violence, most declare themselves traumatized and avoid seeking rights arising from the end of this relationship, such as property rights.
