Abstract(s)
A presente pesquisa se desenvolveu a partir da inquietação sobre se a Justiça Restaurativa, enquanto abordagem viável para mitigar a violência doméstica, pode ser adotada dentro do contexto da relação de intimidade/conjugalidade, em Portugal. O foco central reside na avaliação das dimensões e obstáculos à aplicação de práticas restaurativas, entre outras possíveis e necessárias, em situações de violência doméstica, com a responsabilização social positiva do agente violador de direitos. Essa investigação foi motivada pela elevada taxa de violência, cuja maioria das vítimas é mulher (OMS, 2021), evidenciando a urgência por soluções mais humanizadas, centradas na melhor resposta à mulher, com a reparação, a prevenção e o combate à prática reiterada. Conclui-se que a adoção da JR pode favorecer o enfrentamento e a prevenção da violência na relação de intimidade/conjugalidade, contribuindo para transformação dos aspetos socioculturais relacionados a esta modalidade de violência, destacando a importância da JR como alternativa a integrar o sistema penal, acompanhada por uma avaliação contínua e por políticas públicas afirmativas centradas na mulher.
This research was developed from the concern about whether Restorative Justice, as a viable approach to mitigate domestic violence, can be adopted within the context of intimacy/conjugality in Portugal. The central focus lies in evaluating the dimensions and obstacles to the application of restorative practices, among other possible and necessary ones, in situations of domestic violence, with the positive social accountability of the violator of rights. This investigation was motivated by the high rate of violence, the majority of whose victims are women (WHO, 2021), highlighting the urgency for more humanized solutions, centered on the best response to women, with reparation, prevention and combating the repeated practice. It is concluded that the adoption of RJ can favor the confrontation and prevention of violence in the relationship of intimacy/conjugality, contributing to the transformation of the sociocultural aspects related to this modality of violence, highlighting the importance of RJ as an alternative to integrate the penal system, accompanied by continuous evaluation and affirmative public policies centered on women.
