As crianças representam um dos grupos mais vulneráveis da sociedade em todo o mundo.
A família tem a responsabilidade de ser o primeiro e o mais importante agente no
desenvolvimento pessoal e social do indivíduo. Porém quando essa responsabilidade falha,
quando a família se mostra incapacitada para suprir as necessidades das crianças e quando
esgotadas todas as formas não judiciais, cabe ao Estado e aos Tribunais intervirem no sentido
de proteger e afastar qualquer tipo de perigo que se mostre ameaçador para o bem-estar físico
e psíquico das crianças.
Dada a escassez de estudos direcionados sobre a perspetiva da criança enquanto
interveniente acerca do processo judicial de promoção e proteção tornou-se pertinente incidir
sobre este aspeto. Assim sendo, esta investigação teve como principal objetivo avaliar a
perceção de jovens adultos que já tenham tido acompanhamento dos serviços sociais, mais
concretamente da Equipa Multidisciplinar de Assessoria aos Tribunais (doravante designadas
de EMAT), quando eram ainda menores de idade, face à intervenção de que foram alvo.
Dado o tipo de estudo foi utilizada uma metodologia qualitativa tendo a entrevista como
técnica nuclear de recolha de informação. Foram realizadas 12 entrevistas semi diretivas a
jovens adultos entre os 18 e os 23 anos que quando eram menores de idade beneficiaram de
medidas de promoção e proteção em meio natural de vida e de colocação em instituição.
Após o processo de análise categorial dos dados obtidos nas entrevistas, foi possível
verificar que de um modo geral a audiência judicial criou impacto negativo nos jovens.
Porém relativamente à eficácia da intervenção realizada pela EMAT, esta é percecionada
positivamente. Os resultados sugerem também que a institucionalização é percebida por estes
sujeitos como um ponto de viragem positiva. Considera-se que os dados obtidos vão contribuir e apoiar para um melhoramento de
procedimentos institucionais e vão contribuir também para um reconhecimento de todo o
esforço e trabalho desenvolvido pelos próprios técnicos da EMAT.

However, when families come up short or reveal themselves incapable of suppressing children’s most basic needs and when all non-legal means have been depleted, it is up to the State and the courts to intervene in order to protect and keep children away from endangering their psychic and physical wellbeing. Due to the scarcity of studies about how children perceive their roll within the legal procedures of promotion and protection, it seems adequate to focus these issues from a children’s stand point. Therefore, this study aims to evaluate said perspective, from young adults who were under the Equipa Multidisciplinar de Assessoria aos Tribunais (EMAT) program by the time they were legally minors. After performing a categorical analysis of the data obtained through the interviews, we were able to verify that, in general, the first court hearing had a negative impact on the youngsters. However, when it comes to evaluate the efficiency of the overall program, this is perceived positively and those who have been institutionalized see this moment as turning point of their lives for the better. We believe that the data collected will definitely contribute to the improvement of these legal procedures and to the recognition of the utter most efforts and work of all of the social workers of EMAT.
