O presente projeto de graduação centra-se na análise da mediação enquanto instrumento de promoção da Justiça Restaurativa, tomando como referência os modelos desenvolvidos nos países nórdicos e a sua potencial aplicabilidade ao contexto português. A escolha deste tema decorre da crescente relevância que as práticas restaurativas têm assumido no panorama contemporâneo da justiça criminal, bem como da necessidade de identificar respostas alternativas ao modelo penal tradicional, predominantemente orientado por uma lógica punitiva e retributiva.
O objetivo geral do trabalho consiste em analisar de que modo os modelos de mediação desenvolvidos nos países nórdicos podem servir de referência para o fortalecimento e consolidação da Justiça Restaurativa em Portugal. Entre os objetivos específicos destacam-se a identificação dos princípios e fundamentos teóricos da Justiça Restaurativa, a caracterização das práticas de mediação implementadas no contexto nórdico e a reflexão crítica sobre a viabilidade de adaptação dessas experiências ao sistema de justiça português.
O projeto integra uma proposta de intervenção orientada para a promoção e expansão da mediação restaurativa no contexto nacional. Esta proposta procura evidenciar o potencial da mediação enquanto mecanismo de resolução de conflitos que privilegia o diálogo, a responsabilização do ofensor, a reparação do dano causado à vítima e a reintegração social das partes envolvidas, contribuindo para respostas mais humanizadas e eficazes no âmbito da justiça penal.
O trabalho pretende contribuir para o aprofundamento do debate académico em torno da Justiça Restaurativa e para a identificação de estratégias que possam apoiar o desenvolvimento de práticas e políticas públicas mais coerentes, inclusivas e ajustadas às necessidades do sistema de justiça português.
This graduation project focuses on the analysis of mediation as an instrument for the promotion of Restorative Justice, taking as reference the models developed in the Nordic countries and their potential applicability to the Portuguese context. The choice of this theme stems from the growing relevance that restorative practices have assumed in the contemporary scenario of criminal justice, as well as the need to identify alternative responses to the traditional penal model, predominantly oriented by a punitive and retributive logic. The general objective of the work is to analyse how the mediation models developed in Nordic countries can serve as a reference for strengthening and consolidating Restorative Justice in Portugal. Among the specific objectives, the following stand out: the identification of the principles and theoretical foundations of Restorative Justice, the characterization of mediation practices implemented in the Nordic context, and critical reflection on the feasibility of adapting these experiences to the Portuguese justice system. The project integrates an intervention proposal aimed at promoting and expanding restorative mediation in the national context. This proposal seeks to highlight the potential of mediation as a conflict resolution mechanism that prioritizes dialogue, offender accountability, reparation of harm caused to the victim, and social reintegration of the parties involved, contributing to more humane and effective responses within the criminal justice system. The work aims to contribute to deepening the academic debate surrounding Restorative Justice and to identifying strategies that can support the development of more coherent, inclusive practices and public policies tailored to the needs of the Portuguese justice system.
