O presente projeto de graduação, intitulado “Restaurar para Prevenir: O Lugar da Mediação Penal no Contexto Criminal Português”, propõe-se analisar o papel da mediação penal no sistema criminal português, refletindo sobre o seu contributo enquanto potencial estratégia de prevenção do crime, sobre a redução da reincidência e sobre as suas limitações que condicionam a sua aplicação prática na promoção de uma justiça mais humanizada, participativa e orientada para a resolução construtiva e alternativa dos conflitos no contexto criminal português. Numa primeira parte, o projeto desenvolve um enquadramento teórico centrado nos conceitos de conflito, justiça restaurativa e mediação penal em Portugal, bem como uma breve referência a um contexto internacional, enquanto contribuição para a reflexão crítica sobre a realidade nacional. Numa segunda parte, apresenta-se uma proposta de investigação empírica de natureza qualitativa recorrendo à entrevista semiestruturada como técnica de recolha de dados. A investigação incidirá sobre mediadores, profissionais das instituições judiciais e indivíduos que tenham recorrido à mediação penal, procurando compreender as suas perceções relativamente ao impacto desta prática, às suas potencialidades preventivas e aos aspetos suscetíveis de melhoria. Através da análise de conteúdo das entrevistas, pretende-se identificar contributos relevantes para o desenvolvimento da mediação penal em Portugal.
This graduation project, entitled "Restore to Prevent: The Role of Penal Mediation in the Portuguese Criminal Context," aims to analyze the role of penal mediation in the Portuguese criminal system, reflecting on its contribution as a potential crime prevention strategy, on the reduction of recidivism, and on its limitations that condition its practical application in promoting a more humane, participatory justice oriented towards constructive and alternative resolution of conflicts in the Portuguese criminal context. In the first part, the project develops a theoretical framework focused on the concepts of conflict, restorative justice, and penal mediation in Portugal, as well as a brief reference to an international context, as a contribution to critical reflection on the national reality. In a second part, it presents a proposal for empirical research of a qualitative nature, using semi-structured interviews as a data collection technique. The research will focus on mediators, professionals from judicial institutions, and individuals who have resorted to criminal mediation, aiming to understand their perceptions regarding the impact of this practice, its preventive potential, and aspects that could be improved. Through content analysis of the interviews, the study intends to identify relevant contributions to the development of criminal mediation in Portugal.
