| dc.description.abstract | A Justiça Restaurativa tem se desenvolvido no Brasil, e de forma acentuada no sistema de justiça juvenil. A pesquisa e o estudo, foram desenvolvidos buscando conhecer e analisar as práticas restaurativas no 2º Juizado da Infância e Adolescência em Sergipe e a concepção metodológica em que a JR é aplicada, além dos resultados e significados para o adolescente, a vítima, e seus familiares. Nessa perspectiva, a mudança de olhar ao adolescente infrator, é feita pelos conteúdos de significados do conflito traduzidos para ele, a vítima e seus familiares, próprios da justiça restaurativa e sintonizados em seus princípios, podendo resultar na mudança de olhar institucional, e com ele humanizar o acesso à justiça possibilitando a restauração dos relacionamentos. Para a realização do estudo na pesquisa qualiquantitiva utilizou-se o método de análise documental numa 1ª fase, cuja amostra se constituiu em 352 processos que foram encaminhados, as práticas restaurativas no período de 03 anos; na 2ª fase adotou-se, o método de inquérito por entrevistas semiestruturadas realizadas com a equipe técnica da JR no Juizado da Infância e Adolescência. Na complementariedade dos métodos, pode ser aferido os resultados que permitiram compreender as práticas da Justiça Restaurativa desenvolvidas em Sergipe, envolvendo adolescentes em conflito com a lei, assim identificando os vínculos institucionais, em especial com o Ministério Público, e as estratégicas pedagógicas necessárias para a reinserção social e familiar do adolescente, dito infrator. | pt_PT |
| dc.description.abstract | Restorative Justice has developed in Brazil, and in a marked way in the juvenile justice system. The research and study were carried out seeking to know the existence of restorative practices in the 2nd Court of Childhood and Adolescence in Sergipe and the methodological concept in which JR is applied, in addition to the results and meanings for the adolescent, the victim, and their families. In this perspective, the change of view of the adolescent offender is made by the content of meanings of the conflict translated, by him, the victim and your families, characteristic of restorative justice and in tune with its principles, which can result in a change of institutional view, and with it humanize the access to justice enabling the restoration of relationships. To carry out the study in the field research, the method of document analysis was used in a 1st phase, whose sample consisted of 352 processes that were referred, restorative practices in a period of 03 years; in the 2nd phase, the method of inquiry was adopted through interviews made with the JR technical team in the Childhood and Adolescence Court. In the complementarity of the methods, the results that allowed us to understand the practices of Restorative Justice developed in Sergipe, involving adolescents in conflict with the law, can be measured, thus identifying the institutional links, especially with the Public Ministry, and the pedagogical strategies necessary for the social and family reintegration of the adolescent, the so-called offender. | pt_PT |
