Abstract(s)
O seguinte projeto tem como proposta mostrar a necessidade de compromisso com a mediação penal e justiça restaurativa em Portugal, sendo apresentado à Faculdade de Ciências Sociais e Humanas da Universidade Fernando Pessoa como parte dos requisitos para obtenção do grau de licenciatura em Criminologia, sob orientação do Professor Pedro Cunha. Fundamenta-se teoricamente em temas como o crime e a sua punição, verificando as suas evoluções a fim de perceber a atual justiça retributiva, efetuando uma reflexão sobre a justiça restaurativa e verificando as diferenças significativas entre ambas. Embora a justiça restaurativa não seja algo de novo e seja já objeto de interesse e aplicação em alguns países, na realidade portuguesa a mesma ainda está aquém do desejável em termos da sua verdadeira aplicação. O mesmo é verificável se pensarmos em um dos seus mais importantes procedimentos – a Mediação, cuja difusão e aplicação na realidade nacional está ainda numa fase algo incipiente. Sendo o Sistema de Mediação Penal regido pela Lei nº 21/2007, abordaremos na segunda parte deste projeto possíveis alterações a esta legislação, a fim de uma maior operacionalização da mediação penal em Portugal. Pretende o seguinte projeto concluir a necessidade de mudança de paradigmas, estigmas e evoluindo para a paz social através do meio da mediação penal.
The following project proposes to demonstrate the need for commitment to penal mediation and restorative justice in Portugal. It is presented to the Faculty of Social and Human Sciences of the Fernando Pessoa University as part of the requirements for obtaining a bachelor's degree in Criminology, under the guidance of Professor Pedro Cunha. It is theoretically based on themes such as crime and its punishment, verifying its evolution in order to understand the current retributive justice, carrying out a reflection on restorative justice and verifying the significant differences between both. Although restorative justice is not something new and is already an object of interest and application in some countries, in Portuguese reality it is still less than desirable in terms of its true application. The same is verifiable if we think of one of its most important procedures – Mediation, whose diffusion and application in the national reality is still at a somewhat incipient stage. As the system of penal mediation is under the Law no. 21/2007. in the second part of this project, we shall speak of possible changes in this law so as to achieve a better penal mediation in Portugal. The aim of this project is to conclude that it is necessary to change patterns and stigmas trying to achieve social peace by means of penal mediation.
