O lenocínio, crime associado ao fomento da prostituição na forma de exploração está associado a uma atividade há muito enraizada nas sociedades humanas. Em Portugal, trata-se de um tipo de crime contra a liberdade e autodeterminação sexual, inserido atualmente no Capítulo V do Código Penal. Contudo, desde 1982, este crime tem sofrido diversas alterações a nível legal, que se vão repercutindo na definição legal e na pena atribuída.
Este estudo aborda o tema numa perspetiva jurídica comparada, explorando não só o contexto factual do crime em Portugal, como a sua qualificação do crime à luz dos ordenamentos jurídicos de Espanha e Brasil (para além de Portugal), países de nacionalidade dos principais autores e igualmente das vítimas deste crime. Este estudo, de cariz projetivo, é completado com uma abordagem investigante qualitativa, onde são apresentados dois processos de lenocínio já transitados em julgado, permitindo uma reflexão in concreto sobre o tema.
Prostitution procuring, crime associated to prostitution as a form of exploitation, is linked to an activity historically rooted in human societies. In Portugal, this crime is qualified as a crime against freedom and sexual self-determination, and currently inserted in the chapter five of the Penal Code. However, since 1982, this crime suffered various legal changes, changes that had consequences on the definition of the crime and also on the sentences served. This study looks at the legal comparative perspective, exploring not only the factual context of the crime in Portugal, but also its qualification in the light of the legal orders in Spain and Brazil (together with Portugal), the countries of nationality of most authors and also of most victims of this crime in Portugal. This study, which is a project in its matrix, is completed by a qualitative research approach, where two judicial processes on prostitution procurement already judged is presented, allowing for a reflection in concreto on the topic.
