| dc.description.abstract | A criminalidade feminina tem vindo progressivamente a aumentar potenciando o desenvolvimento de vários estudos sobretudo no contexto internacional. Pese embora os desenvolvimentos que este tema tem tido no contexto português, carecem estudos que se centrem na forma como a mulher é percebida e tratada pelo sistema de justiça. A presente dissertação de mestrado procura dar um contributo neste sentido, estando dividida em dois artigos científicos. O primeiro retrata uma revisão estruturada da literatura onde foram analisados 30 artigos com enfoque nas disparidades detetadas ao nível das sentenças que envolvem mulheres. Assim, verificou-se que entre os diferentes fatores que influenciam nas sentenças judiciais foram: idade, existência de filhos, raça, tipo de crime praticado, escolaridade e antecedentes criminais. O segundo é um artigo de natureza empírica, dando conta de um estudo de caráter qualitativo e quantitativo com a finalidade de procurar identificar e perceber os fatores que são considerados pelos atores judiciais aquando do julgamento de crimes praticados por mulheres. Em termos de resultados este segundo artigo foi ao encontro dos resultados do primeiro. Os antecedentes criminais, o modus operandi, a perceção sobre a responsabilidade criminal, o grau de ilicitude, bem como as características das vítimas foram identificadas como variáveis importantes na tomada de decisão judicial. Assim, com esta revisão estruturada da literatura e com a investigação realizada, conseguimos saber quais os fatores promotores de disparidades ao nível das sentenças. | pt_PT |
| dc.description.abstract | The female criminality has been gradually increasing, thus encouraging research about this topic, mostly in the international atmosphere. Even though there is already a substantial development in this field of research in Portugal, there is a lack of research focusing on how women are perceived and treated by the legal system. This dissertation aims to fulfil such gap with two scientific articles. The first counts with a literature review, in which there were analysed 30 articles that focused on the discparities in sentences involving women. Thus, it was verified that amongst the different factors that influence the judicial sentences the following were: age, having children, race, type of crime committed, schooling and the criminal record. The second article was an empirical article, composed by a qualitative and quantitative study with the goal of identifying and understand the factors considered by the judicial operators faced with a criminal conduct committed by women. Regarding the results of this article, they were in accordance with the ones from the first article. The criminal records, the modus operandi, the perception of criminal responsibility, degree of unlawfulness, as well as the characteristics of the victims were identified as critical variables in the judicial decision. Consequently, with this literature review and research, we were able to know which factors lead to disparities in sentences. | pt_PT |
