Liberdade individual versus segurança do estado: reflexão sobre as suas tensões na luta contra novos crimes

| dc.description.abstract | Atualmente a maior parte dos países no mundo ou mesmo todos criaram no seu território uma base de segurança muito forte, esquecendo-se de colocar a liberdade dos cidadãos num mesmo pé de igualdade, facto que cria um certo desconforto e até mesmo revolta por parte dos cidadãos. Face ao contexto atual, a maior parte dos cidadãos hoje vivem cercados de um dispositivo de segurança que colocam em causa os seus direitos e liberdades. O objetivo dessa investigação passa por aprofundar a tensão acima referidos e a reflexão na luta contra novos crimes, nomeadamente o crime de terrorismo. O problema colocado parte do facto que parece generalizado, por todos os países e organizações internacionais, a bandeira da segurança em detrimento das liberdades individuais. Com o presente estudo, procura-se determinar as causas que levaram a que estes dois princípios, a liberdade e a segurança – que são direitos fundamentais -, se distanciassem até este ponto. Para o efeito iremos proceder a análise de alguns sistemas teóricos, tentando aproximar a possibilidade da adaptação dos mesmos à realidade atual de forma a poder contribuir para a melhoria do sistema democrático ou mesmo para a garantia da sua subsistência. Com esse excesso de segurança, assiste-se apenas a uma mudança? Uma evolução? A uma evolução natural de interesses antagónicos entre liberdades individuais/segurança dos estados? Ou a primazia de um direito em detrimento de outro? O estudo que se propõe obedecerá a uma plataforma descritiva e quantitativa, baseada numa pesquisa que se servirá do inquérito enquanto método que será suportado pela técnica do questionário. Do estudo empírico realizado nessa investigação, foi possível apurar que na balança existente entre liberdades individuais versus segurança dos Estados, denota-se grande inclinação na preferência do direito a segurança dos Estados, visto que essa se reflete na vida dos cidadãos que por sua vez se sentem mais seguros no contexto atual. | pt_PT |
| dc.description.abstract | At present most of the countries in the world, or even all of them, have created a very strong security base in their territory, forgetting to place citizens' freedom on the same footing, which creates a certain discomfort and even revulsion on the part of of citizens. In the face of the current dispute, most citizens today are surrounded by a security device that jeopardizes their rights of freedoms. The objective of the investigation is to deepen the conflict between the aforementioned rights and the reflection on the fight against new crimes. It has relevant results and in its predominance are congruent the predominant literature, demonstrating on the one hand, the applicability in the context where the study was carried out, of the theories usually used in the investigations and reflections of its tensions in the fight against new crimes. However, the problem tends to be widespread across all countries and international organizations, which carry the banner of security to the detriment of individual freedoms. The present study also seeks to determine the causes that led to these two principles, or fundamental rights, to distance themselves to this point. To this end, we will analyze some systems of security and participation in freedom, trying to approximate the possibility of adapting them to the current reality in order to contribute to the improvement of the democratic system or even to guarantee their subsistence. With this excess of security, is there only a change? An evolution? A natural evolution of conflicting interests between individual freedoms / state security? Or the primacy of one right over. The proposed study will be based on a descriptive and quantitative platform, based on a survey that will be used as a method that will be supported by the questionnaire technique. From the empirical study carried out in this investigation, it was possible to verify that in the balance between individual freedoms versus State security, there is a great inclination in the preference for the right to the security of the States, since this is reflected in the life of the citizens that in turn feel safer. | pt_PT |
