Abstract(s)
Na presente investigação procura-se compreender em que consiste a justiça restaurativa, tanto no plano teórico quanto no prático. Apresentam-se a teoria da justiça restaurativa, seus conceitos, ideias propulsoras de seu surgimento, comparação com a justiça penal, algumas concepções e modelos teóricos para seu funcionamento, além de algumas críticas opostas ao movimento restaurativo. Para avaliar a repercussão da justiça restaurativa no Brasil, foram analisadas as seguintes publicações do Conselho Nacional de Justiça: Consulta Pública sobre o Planejamento da Política Pública Nacional do Poder Judiciário (2019), Justiça em Números (2019, ano-base 2018), Mapeamento dos Programas de Justiça Restaurativa (2019) e Pilotando a Justiça Restaurativa: o papel do Poder Judiciário (2018), além de estudos de caso relatados em trabalhos acadêmicos. Com base nelas, efetuou-se uma avaliação da distribuição dos programas no território nacional e destacaram-se as principais características das práticas adotadas pelos profissionais da justiça restaurativa. Em termos metodológicos, foram utilizadas as técnicas de revisão bibliográfica para o capítulo teórico, além de levantamento e análise de dados secundários oriundos das publicações nomeadas. Os resultados apontam que o planejamento da política pública nacional de justiça restaurativa do Poder Judiciário tem apresentado uma aceitação significativa pela gama de profissionais com vivência nesta prática. Com relação aos programas, projetos ou ações em justiça restaurativa, viu-se que, na maioria dos casos, tais iniciativas não possuem espaço exclusivo para a realização de suas práticas. Por outro lado, a respeito das metodologias restaurativas, observou-se também que as mais utilizadas são aquelas ligadas às práticas circulares. Além disso, a maior parte dos programas, projetos ou ações possui como foco os conflitos envolvendo infância e juventude, infrações criminais leves e violência doméstica. Apesar de todos os limites, o campo dos procedimentos em curso das iniciativas da justiça restaurativa está produzindo impacto positivo na vida das pessoas, das comunidades e das instituições envolvidas.
The aim of the present research is to comprehend what restorative justice consists of, both theoretically and practically. The theory of restorative justice is presented, along with its concepts, the driving ideas behind its emergence, a comparison with criminal justice, some concepts and theoretical models for its operation, and some criticisms by those opposed to the restorative movement. In order to evaluate the impact of restorative justice in Brazil, the following publications by the National Board of Justice were analyzed: “Public Consultation regarding the National Public Policy Planning of the Judiciary Branch” (2019), “Justice in Numbers” (2019, base year 2018), “Survey of the Restorative Justice Programs” (2019) and “Piloting Restorative Justice: the Role of the Judiciary Branch” ( 2018). Other related case studies were examined in academic projects. Based on these studies, an evaluation of the distribution of national programs was made and the main characteristics of the practices adopted by restorative justice professionals stood out in the analysis. In methodological terms, the techniques of bibliographical review were utilized for the chapter on theory, as well as the gathering and analysis of secondary data derived from the previously mentioned publications. The results show that the restorative justice national public policy planning by the judiciary branch has displayed significant acceptance by the array of professionals with experience in the field. In relation to the programs, projects, or suits in restorative justice, one could see that, in most cases, such initiatives did not possess exclusive space for the completion of their practices. On the other hand, regarding restorative methodologies, one could observe also that the ones which are most used are those related to circular practices. Besides this, the majority of programs, projects, or suits have as their focus the conflicts involving childhood and youths, minor criminal infractions, and domestic violence. Despite all limitations, the field of ongoing procedures of initiatives by restorative justice is producing positive impact in people’s lives, communities, and related institutions.
