O enquadramento jurídico das criptomoedas em Portugal: uma análise crítica no âmbito penal

Abstract(s)
As criptomoedas têm vindo a assumir um papel crescente na economia digital, suscitando desafios significativos para o sistema jurídico, particularmente no âmbito do Direito Penal. Este projeto propõe uma análise aprofundada do enquadramento legal das criptomoedas em Portugal, destacando as lacunas normativas e insuficiências existentes na sua tipificação penal, em consonância com o Código Penal, o Regime Geral das Infrações Tributárias (RGIT) e o Regulamento Europeu MiCA. Inclui-se um estudo empírico detalhado de um acórdão proferido pelo Tribunal da Relação de Lisboa, que evidencia como o sistema judiciário português está a enfrentar a criminalidade associada aos criptoativos, nomeadamente no âmbito do branqueamento de capitais. Através da conjugação da análise teórica e prática, o trabalho procura contribuir para o debate jurídico, evidenciando a necessidade urgente de atualização normativa e harmonização legislativa, que garanta respostas eficazes, claras e adequadas às especificidades técnicas das novas tecnologias financeiras.
Por fim, pretende-se fornecer uma base sólida para futuras reflexões académicas e propostas legislativas, alinhadas com os desenvolvimentos europeus e com os princípios de um sistema de justiça moderno, transparente e capaz de responder aos desafios da era digital, onde a inovação tecnológica exige respostas jurídicas mais ágeis, coerentes e eficazes. A presente investigação ambiciona, assim, sensibilizar a comunidade jurídica e académica para a importância de uma atuação mais célere e sistemática por parte do legislador, tendo em vista a crescente sofisticação dos crimes digitais e a urgência em proteger os bens jurídicos fundamentais no novo panorama tecnológico.
Cryptocurrencies have been playing an increasingly important role in the digital economy, posing significant challenges to the legal system, particularly in the area of criminal law. This project proposes an in-depth analysis of the legal framework of cryptocurrencies in Portugal, highlighting the regulatory gaps and shortcomings in their criminal typification, in line with the Penal Code, the General Regime of Tax Offences (RGIT) and the European Regulation MiCA. It includes a detailed empirical study of a judgment handed down by the Lisbon Court of Appeal, which highlights how the Portuguese judicial system is addressing crime associated with crypto assets, particularly in the area of money laundering. By combining theoretical and practical analysis, this work seeks to contribute to the legal debate, highlighting the urgent need for regulatory updates and legislative harmonization, which ensures effective, clear and appropriate responses to the technical specificities of new financial technologies. Finally, it aims to provide a solid basis for future academic reflections and legislative proposals, aligned with European developments and the principles of a modern, transparent justice system capable of responding to the challenges of the digital age, where technological innovation requires more agile, coherent and effective legal responses. This research thus aims to raise awareness in the legal and academic community of the importance of faster and more systematic action by the legislator, in view of the increasing sophistication of digital crimes and the urgency of protecting fundamental legal assets in the new technological landscape.
