Abstract(s)
Os critérios adotados pela justiça para delimitar a culpabilidade da pessoa acometida por transtornos mentais exigem discussões desde épocas passadas. A lei penal brasileira estipula critérios diferenciados no julgamento de indivíduos detentores de problemas psíquicos envolvidos em ilícitos penais, de maneira que para que lhe seja atribuída a inimputabilidade, são necessárias análises periciais embasadas nos critérios e saberes da psiquiatria. O objeto desse estudo corresponde ao exame dos laudos psiquiátricos constantes nos autos, por ser instrumento de avaliação individualizada e sendo este constituído por diversas variáveis, sua validação constata a integralização do sistema judicial aos pormenores trazidos pela análise psicológica do apenado considerando suas limitações psíquicas. Mediante a formulação de quesitos pelas partes e pelos documentos acostados aos autos trabalhamos o objeto da pesquisa mediante o auferimento do conteúdo e técnicas utilizadas pelo escopo psiquiátrico no processo de Incidente de Insanidade Mental. O presente trabalho pretende fazer uma análise sobre o valor probante do laudo psiquiátrico tendo em vista que o diagnóstico do exame pericial é efetuado em observância ao histórico pessoal do réu, das condições intelectuais à época do crime, das variáveis e elementos potencializadores a que estão inseridos, de maneira a se constituir como parâmetro determinante na proferição de decisão do Magistrado quanto a inimputabilidade do acusado. Para cumprir esses objetivos recorreu-se à coleta de 10 processos de Incidente de Insanidade Mental pertencentes à 47ª, 49ª, 53ª e 55ª Promotorias de Justiça Criminal de Maceió, Estado de Alagoas, de forma que os laudos psiquiátricos como meio de prova subsidiam de maneira significante a decisão final do magistrado quanto ao reconhecimento da Inimputabilidade do réu acometido por transtornos mentais.
The criteria adopted by justice to delineate the guilt of the person affected by mental disorders require discussions since the past. Brazilian criminal law stipulates differentiated criteria in the judgment of individuals with psychic problems involved in criminal offenses, so that in order to be attributed to non-accountability, expert analyzes based on the criteria and knowledge of psychiatry are necessary. The object of this study corresponds to the examination of the psychiatric reports in the case records, since it is an individualized evaluation instrument and this one consists of several variables, its validation confirms the completion of the judicial system to the details brought by the psychological analysis of the distressed considering its psychic limitations. Through the formulation of questions by the parties and the documents in the case, we work the object of the research through the collection of the content and techniques used by the psychiatric scope in the process of Mental Insanity Incident. The present work intends to make an analysis about the evidentiary value of the psychiatric report, considering that the diagnosis of the expert examination is done in compliance with the personal history of the defendant, the intellectual conditions at the time of the crime, the variables and the empowering elements to which they are inserted , in order to be a determining parameter in the decision of the Magistrate regarding the imputability of the accused. In order to fulfill these objectives, 10 cases of Mental Insanity Incidents belonging to the 47th, 49th, 53rd and 55th Criminal Justice Prosecutors of Maceió, State of Alagoas were collected, so that psychiatric reports as a means of proof significant the final decision of the magistrate regarding the recognition of the Imputability of the defendant affected by mental disorders.
